This Privacy Policy applies to our website as well as our application. By accessing or using our Service, you acknowledge that you have read, understood, and agreed to the collection, storage, use, and disclosure of your personal information as described in this Privacy Policy and our Terms of Service.


Clarifications and Definitions

Clause One: Definitions

For the purposes of this Privacy Policy:

·        “Applications” means all Company applications across Android and Apple iOS operating systems.

·        “Account” means a unique account created for you specifically to access our Service or part of our Service.

·        “Company” (referred to in this Policy as the “Company”, “we”, “us”, or “our”) means our Company.

·        “Cookies” are small files placed by websites on your computer, mobile device, or any other device, containing details and information relating to your use of the website.

·        “Customer” means the female user who registers to use the Company’s services.

·        “Device” means any device through which the Service may be accessed, such as a computer, mobile phone, or tablet.

·        “IP Address” means the numerical label assigned to each device connected to the internet. These numbers are generally assigned within geographic blocks and may often be used to identify the geographic location from which the device connects to the internet.

·        “Personal Data” means any information relating to an identified or identifiable individual.

·        “Service” means the Company’s website and applications.

·        “Service Provider” means any natural or legal person who processes data on behalf of the Company. The term refers to third-party companies or individuals engaged by the Company to facilitate the Service, provide the Service on the Company’s behalf, perform services related to the Service, or assist the Company in analyzing how the Service is used.

·        “Usage Data” means data collected automatically, generated either by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit on the website).

·        “Website” refers to the Company’s website, accessible at: https://kaiian.com

·        “You” means the individual female user accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.


Clause Two: Collection and Use of Your Personal Data

Types of Data Collected

1. Customer Personal Data

While using our Service, we may ask you to provide certain personally identifiable information that may be used to contact or identify you. Such personal information may include, but is not limited to:

·        Email address

·        First name and last name

·        Phone number

·        Address, country, province, postal code, and city

·        Usage Data

The user must be at least 18 years of age, in accordance with the laws applicable in the Kingdom of Saudi Arabia. Accordingly, at the time of registration and placing orders, the user must not be under 18 years old.

2. Female Driver Personal Data

While using our Service, we may ask you to provide certain personally identifiable information that may be used to contact or identify you. Such personal information may include, but is not limited to:

·        Email address

·        First name and last name

·        Phone number

·        Address, country, province, postal code, and city

·        Driver’s license details and a copy thereof

·        Identity details and a copy thereof

·        Vehicle registration details and a copy thereof


Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as your device’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of the Service or website that you visit, the time and date of your visit, the time spent on those pages, device identifiers, and other diagnostic data.

We may also collect certain information automatically when you use or access the Service through a mobile device, including, without limitation, the type of mobile device you use, your mobile device’s unique ID, your mobile device IP address, your mobile operating system, the type of mobile internet browser you use, device identifiers, and other diagnostic data.

We may also collect information that your browser sends whenever you visit our Service or access the Service through a mobile device.


Cookies and Tracking Technologies

We use Cookies and similar tracking technologies to track activity on our Service and store certain information. Tracking technologies used may include web beacons, tags, and scripts to collect and track information and to improve and analyze our Service. The technologies we use may include:

·        Web Beacons: Certain sections of our Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email, and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity).


Use of Your Personal Data

The Company may use your Personal Data for the following purposes:

·        To provide and maintain our Service, including monitoring the usage of our Service.

·        To manage your Account: to manage your registration as a user of the Service. The Personal Data you provide may give you access to various functionalities of the Service available to you as a registered user.

·        For contractual performance: to fulfill and comply with the purchase contract for services you have purchased or any other contract concluded through the Service.

·        To contact you: by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as mobile application push notifications regarding updates or informative communications related to the functionalities, products, or contracted services, including security updates, where necessary or reasonable.

·        To provide you with news, special offers, and general information about other goods, services, and events that we offer similar to those you have already purchased or inquired about, unless you have opted not to receive such information.

·        To manage your requests.

·        For business transfers: we may use your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by us about our Service users is among the assets transferred.

·        For other purposes: such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate and improve our website, application, products, services, marketing, and your experience.


Third-Party Services

We may share the personal and non-personal information we collect with third parties such as advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we believe may interest you. We may also share such information with our current and future affiliates and business partners. In the event that we are involved in a merger, asset sale, or other business reorganization, we may also share or transfer your personal and non-personal information to our successors-in-interest.

We may engage trusted third-party service providers to perform functions and provide services such as hosting and maintaining our servers and mobile application, database storage and management, email management, storage, credit card processing, customer service, and order fulfillment for products and services that you may purchase through the application. We may share your personal and non-personal information with such third parties to enable them to perform those services for us and for you.

We may share portions of log file data, including IP addresses, for analytics purposes with third parties such as web analytics partners, application developers, and advertising networks. Your IP address may be used to estimate geographic location and other technical information such as connection speed, whether you have visited the application from a shared location, and the type of device used to access the application. Such third parties may compile information about our advertisements and what you view on the application, and provide auditing, research, and reporting for us and our advertisers.

We may also disclose your personal and non-personal information to government authorities, law enforcement officials, or private parties where we believe such disclosure is necessary or appropriate in order to respond to claims and legal processes (including subpoenas), to protect our rights and interests or those of a third party, to protect the safety of the public or any person, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with court orders and applicable laws, rules, and regulations.


Retention of Your Personal Data

The Company will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except where such data is used to strengthen security or improve the functionality of our Service, or where we are legally obligated to retain such data for longer periods.


Deletion of Your Personal Data

·        Your Personal Data may be deleted upon a formal request and verification of the identity of the data owner through WhatsApp communication via the unified number: 920009771.

·        We will respond to requests for deletion and transfer of submitted personal data via email or through approved communication channels within one month, and we will specify the timeframe for deletion and transfer of the data.


Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company’s operating offices and in any other places where the parties involved in the processing are located. This means that such information may be transferred to — and maintained on — computers located outside your state, province, country, or other governmental jurisdiction where data protection laws may differ from those of your jurisdiction.

By agreeing to this Privacy Policy and submitting such information, you consent to such transfer.

The Company will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy, and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place, including the security of your data and other personal information.


Account Data Deletion Procedure

1.     The female driver or female customer may delete her account and data directly through the applications, which include a full data deletion option as an initial choice. In such case, the account, including the associated data, will be automatically deleted from the system within a maximum period of three months.

2.     If access to the application is not possible or if the user wishes to request deletion, the request must be submitted exclusively through the official channels via the unified number 920009771. The applicant will be contacted within a period that may extend up to one month, either by phone call or WhatsApp, after which deletion procedures will commence.

3.     All trips, financial transactions, and complaints associated with the account will be reviewed, particularly where the female driver has operated in more than one city. This process requires time, and accordingly no fixed timeframe is set for completion of the procedure, as previously stated.

4.     If there are any amounts linked to the account, the data cannot be deleted before verifying the source of such amounts, whether they are outstanding fees or accrued entitlements belonging to the account holder.

5.     After completion of the review, all financial transactions will be archived in the independent financial system, and trip transactions will also be archived through the Wasl platform التابعة لهيئة النقل (Transport General Authority platform).

6.     The account holder will be contacted through the available communication channels to obtain her final approval for data deletion. The account will then be deleted after any balance due to her has been transferred, if applicable.

7.     The female driver will be notified via WhatsApp from our official unified number 920009771 using the following wording:
“Dear Captain, pursuant to your request to delete the account, including personal data, vehicle information, trip data, and financial transaction data, we hereby inform you that the account has been deleted. If there is any available balance, it will be transferred to you within a maximum period of two weeks.”

Fifth: Please note that completion of deletion procedures does not necessarily mean that messages from the Absher platform, the Wasl databases, or the Transport Authority will cease immediately, nor does it necessarily prevent promotional offers from continuing to arrive through the Company’s channels, as some residual data may remain pending.


Immediate Suspension Clause for Drivers

Without prejudice to the laws and regulations applicable in the Kingdom of Saudi Arabia, the application reserves the right to suspend or terminate a female driver’s (Captain’s) account, temporarily or permanently, without prior notice, if she commits serious violations including, without limitation, insulting, defaming, or harming the reputation of the application or its brand, inciting others against the application, or publishing misleading information or abusive content.

Moderate violations may result in a warning or temporary suspension, and repeated violations shall be considered serious violations. The application reserves the right to assess and classify the violation. The female driver has the right to submit an objection within five (5) business days from the date of suspension via WhatsApp at 920009771, accompanied by supporting evidence. Such objection shall be reviewed within a period ranging from ten (10) to thirty (30) business days, and the suspension shall remain in effect until a final determination is made. The decision shall be final, without prejudice to the right to resort to the competent judicial authorities, and the application reserves the right to claim compensation for any resulting damages.


Clause Three: Commercial Transactions

If the Company is involved in a merger, acquisition, or sale of assets, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different privacy policy.


Compliance with Law and Misuse Fees

Under certain circumstances, the Company may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (for example, a court or government agency).

By registering with us, you agree that the Company may apply its specific and general terms and conditions concerning misuse fees or inappropriate conduct with customers, which may subject you to certain penalties and charges for such violations in accordance with the Company’s internal rules and regulations.


Profit Disbursement

Profits shall be disbursed to each female captain where her wallet balance is SAR 200 or more, after the female captain submits a request through the unified number, noting that the female captain shall bear the profit disbursement fees.


Driver Compensation

A female driver may request compensation for a cancelled trip, provided that she has reached the pickup location. The application reserves the right not to compensate the female captain. Compensation shall be credited to the female driver’s wallet, provided that the maximum compensation for cancelled trips is SAR 5.

In the event of any request concerning a cancelled trip, the female driver must contact technical support through the unified number 920007791. No financial compensation may be claimed for cancelled trips if more than 24 working hours have elapsed from the trip time.


Maximum Compensation Limits According to Cancellation Cases

A female driver may be compensated for non-payment up to four times per month, with a total maximum compensation amount of SAR 200 for all claims. The Company reserves the right to reject compensation to female captains after reviewing the case and verifying that compensation is not warranted.


Financial Transfer and Operating Fees

The female captain may request the transfer of the amounts in her wallet at any time, and may subscribe to an instant daily transfer service. The fee for each financial transfer transaction is SAR 5 per transaction.

If the female captain incorrectly tops up her wallet and wishes to recover the amount, fees equivalent to the electronic payment gateway charges, transfer fees, and estimated operating fees shall be applied. The amount will then be transferred after verification of the account holder’s identity and banking details. The applicable fee shall range from SAR 50 minimum to SAR 200 maximum, provided that the amount does not exceed SAR 5,000.


Financial Incentives and Offers for Drivers

Financial rewards shall be disbursed after the marketing campaign within 3 to 5 business days. Please note that a female driver shall not be entitled to receive the reward if she commits any misuse on the day of the promotional offer, such as starting and ending the trip on the customer without a genuine ride, rejecting a request, ignoring a request, or being the subject of a complaint from a customer.

Any of the foregoing shall automatically invalidate the incentive or offer granted to the female captain, and she shall have no right whatsoever to claim it.


Request for Performance or Trip Reports

The female captain may request a report on the total trips completed during her period of work on the partner application. Such report is issued for a service fee of SAR 30. The report may cover up to one month maximum and shall be issued within 72 hours maximum.


Application of ZATCA Terms and Conditions

A 15% Value Added Tax (VAT) shall be applied in accordance with the rules, regulations, and provisions of the Zakat, Tax and Customs Authority, with reference to the Executive Regulations of the VAT Law and the amendments introduced to Article (47), which entered into force on 1 January 2026, concerning the mechanism for calculating VAT for electronic platforms.

The VAT amount shall be charged to the female customer and, in the case of cash payment, shall be collected by the female driver. Additional charges may also apply, such as the Wasl platform fee of SAR 0.58 per trip, and an additional SAR 1 per trip through the Kaiian application. Prices shall also be subject to VAT, particularly as the female customer bears such costs.


Application of Transport General Authority (TGA) Requirements

·        The female driver must be a Saudi national

·        She must hold a valid driver’s license

·        Her Absher criminal background check request must be approved

·        Her status on the Wasl platform must be VALID


Other Legal Requirements

The Company may disclose your Personal Data in the good-faith belief that such action is necessary to:

·        Comply with a legal obligation

·        Protect and defend the rights or property of the Company

·        Prevent or investigate possible misconduct in connection with the Service

·        Protect the personal safety of Service users or the public

·        Protect against legal liability


Security of Your Personal Data

The security of your Personal Data is extremely important to us. However, please remember that no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.


Links to Other Websites

Our Service may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s website. We strongly advise you to review the privacy policy of every website you visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.


Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will also notify you by email and/or through a prominent notice on our Service (our website or application) before the change becomes effective, and we will update the “Last Updated” date at the top of this Privacy Policy.

Usage, Safety, and Conduct Regulations

When requesting a trip, the following are prohibited under the applicable rules and regulations:

·        Smoking is strictly prohibited.

·        Intercity transportation of passengers is strictly prohibited.

·        Seat belt use is mandatory.

·        You must not share your personal data, as only the minimum necessary data is displayed to the female driver through the application.

·        The female passenger shall not bear the cost of any traffic violations committed by the female driver during the trip.


Google Sign-In

We use Google Sign-In data to register you in My Hub and the Operator application. When you sign in through Google, we receive certain information about you depending on your sign-in method, which may include your name, geographic location, language, profile picture, and email address. We comply with Google API Services User Data Policy.


Apple Pay Integration

If you choose to top up your wallet using Apple Pay, we will collect and process certain information required to facilitate the transaction, such as your Apple Pay account details and the amount to be added. Such data is transmitted and managed securely in accordance with Apple’s privacy and security standards. We do not store your payment information or share it with unauthorized third parties. All transactions are subject to Apple’s Privacy Policy and Terms of Service.
